Abstract

The issue of employee reintegration to the workplace has always been a point of special interest in the field of labor and labor law, especially in a contemporary transitional society such as Serbian. Reintegration, or return of an employee to work, is regulated by the Law on Enforcement and Security as a separate type of executive procedures. The Law prescribes that the court or a judge shall be exclusively competent to conduct enforcement procedure for the return of an employee to work. First, the court decision is issued to the employer. Secondly, if the employer fails to comply, the court imposes a fine, which can be extended and increased, if the employer should persist in not acting on the decision. In addition to the employer, a wage penalty is imposed on the responsible party within the organization. The process of reintegration to work shall also ensure that other legal rights that an employee may have been denied during their unlawful removal are re-asserted. The Law stipulates that the employer pays damages to the employee in the amount of lost earnings as well as the social security contributions for the duration of their absence from the workplace. This paper will discuss the specific details regarding the execution of court decisions in the case of unlawful termination of employment.
