Abstract

This article examines constitutional memory in Serbia after the collapse of socialism and the dissolution of Yugoslavia. At this historical crossroads, Serbia reassessed two major strands of its constitutional past: the tradition of bourgeois constitutionalism and the experience of socialist constitutional development. The former became the source of largely affirmative constitutional memories, while the latter was predominantly associated with negative memories of ideological distortion and deviation from liberal constitutionalism. Yet both legacies found their place in Serbia’s latest constitutional projects, first in 1990 and then in 2006. The article focuses on three themes of particular political and constitutional relevance: democracy, statehood, and Europe (Europeanization). It shows how constitutional debates surrounding these themes relied on historical narratives as sources of legitimation, while also revealing broader patterns of Serbia’s constitutional self-understanding as an old European democratic nation. The empirical findings confirm the relevance of constitutional memory as a theoretical concept for various forms of constitutional analysis, particularly for constitution-making.
