Expertise is certainly one of the most important means of proof. Together with public documents, expert opinions which give experts of certain professions have the highest legal force in determining certain facts. The importance of expertise is primarily in the fact that the expert is defined as professional who possess certain knowledge. In addition to knowledge, expert must possess certain skills that have been acquired as a result of many years of practice and professional activities. High position of experts in the scale of evidence is primarily a result of their expertise but also objectivity. The expert must be completely impartial in giving his expert opinion and that is particularly emphasized in all the regulations governing area of expertise.Expertise as evidence is provided in several procedural laws but unfortunately we have to note that these provisions are jagged and unsettled. This paper provides an overview of the provisions that were incorporated into the law, which in our opinion have not been phrased well, and also much more suggestions on matters that have not been covered by this legal text.
