Abstract

The Competition Protection Act has been effective for more than three years now. In this period, we have been able to observe some of its drawbacks which have been an obstacle to the effective application of the competition rules in the Republic of Serbia. Apart from certain inconsistencies and non-conformity of our substantive law with the EU law, the key drawback is reflected in the limited competences of the Competition Protection Commission the proceedings against the market participants who have violated the competition rules. In the proposal on the new Competition Protection Act, the legal framework for the protection of the competition on the market has been significantly improved. The Competition Protection Commission has been given important competences in the proceeding for establishing the violation of competition rules, which should facilitate the Commission’s work on collecting evidence. The Commission is also entitled to award fines and impose other measures on the market participants which are supposed to contribute to the preservation or establishment of market competition. Finally, the proposal has introduced the institute of release (exemption) or leniency in determining the sentence (punishment) for the cartel participants who make themselves known to the Commission, report unfair competition on the market and submit evidence to that effect. In this paper, the author analyses the proposed legal solutions from the aspect of their conformity to and compliance with the European and international standards, as well as with the legal tradition of the Serbian legal system.
